Pending Settlement in Unsolicited Telephone Facsimile Case

If you received an unsolicited telephone facsimile advertisement from AMF Bowling Centers in Georgia, you may be eligible for $500, as part of a pending court settlement. Fulfilling its role as monitor/regulator of the telecommunications industry, the Georgia Public Service Commission brings to the attention of Georgians a telecommunications matter that is pending resolution in Fulton County Superior Court. James Michael Moore d/b/a/ Satellite Specialists against AMF Bowling Centers, Inc. (AMF) is a case that involves transmission of unsolicited facsimiles, a practice which violates the Federal Telephone Consumer Protection Act of 1991 (47 U.S.C. § 227). The settlement class is defined as all persons or entities who maintain that they received an unsolicited telephone facsimile advertisement from, or on behalf of, AMF in Georgia. Once the case receives final approval by Superior Court, AMF will establish a fund of up to $1 million that will be disbursed in the following manner:

  • Each claimant who is able to produce the actual AMF fax or can be identified as having received a fax from AMF’s records will be given $500 or a prorated amount if the fund is ina dequate.
  • AMF certificates in the amount of $250 will be given to claimants who can’t produce an actual fax, but who submit sworn declarations stating they received an unsolicited fax.
  • At the end of eight (8) months, remaining funds will revert back to AMF less a payment of up $100,000 to be divided equally between the Atlanta Legal Aid Society, Inc. and the Georgia Legal Services Program.
